Avrio ETD Portfolio App Licence Terms

These Licence Terms govern the purchase and use of the Avrio ETD Portfolio App, supplied by Avrio Products.

By purchasing, activating or using the App, you confirm that you have read and accepted these terms.

1. Licence Granted

Your purchase provides you with a limited, non-exclusive and non-transferable licence to use the Avrio ETD Portfolio App.

The licence is issued to one individual ETD practitioner and may be activated on a maximum of two supported devices belonging to or primarily used by that practitioner.

The licence does not transfer ownership of the App, its software, design, content or intellectual property to the purchaser.

2. Permitted Use

You may use the App to:

• Record your facilitation, assessment and moderation activities
• Record hours worked and relevant professional information
• Add and manage supporting photographic evidence
• Filter and review your activity records
• Generate, print or save activity reports
• Prepare summaries for sharing by email or WhatsApp

You may use reports and summaries generated from your own information for legitimate professional and record-keeping purposes.

3. Licence Restrictions

You may not:

• Share your activation code with another person
• Allow another practitioner to use your licence
• Sell, transfer, rent, sublicense or redistribute access to the App
• Copy, reproduce or distribute the App or any part of its software
• Attempt to reverse-engineer, modify, bypass or interfere with the App or its licence controls
• Use the App for any unlawful, fraudulent or unauthorised purpose
• Claim ownership of the App, its design or its functionality

Additional licences must be purchased for additional practitioners.

4. Device Activation

One individual licence may be activated on up to two supported devices.

A browser, device replacement, cleared browser data or certain software changes may be recognised as a new device. If you reach your activation limit because a device has been replaced, lost or reset, contact Avrio Products for assistance.

Device resets are considered individually and may require reasonable verification of the original purchase and licence holder.

Compatibility cannot be guaranteed with every device, browser, operating system, security setting or future software version.

5. Activation Details

Your App link and personal activation code will be supplied after your order and payment have been processed.

You are responsible for:

• Providing the correct contact information when ordering
• Keeping your activation code private and secure
• Informing Avrio Products if you believe your code has been shared or used without permission
• Ensuring that only the licensed practitioner uses the activation details

Avrio Products may suspend or deactivate a licence if there is reasonable evidence of unauthorised sharing, misuse, fraud or an attempt to bypass the licence restrictions.

6. User Records and Supporting Evidence

You remain responsible for the accuracy, completeness, relevance and lawful use of all information and evidence entered into the App.

You must ensure that:

• You have the right or appropriate permission to record the information
• Photographs and supporting evidence are relevant and lawfully obtained
• Personal or confidential information is handled responsibly
• Information shared in reports, emails or WhatsApp messages is sent to the correct recipient
• Your use of the App complies with your employer’s, client’s, training provider’s or professional body’s requirements

The App does not independently verify the accuracy, authenticity or professional acceptability of information entered by a user.

7. Privacy and Personal Information

The App may process information supplied by you to provide its record-keeping and reporting functions.

You should avoid entering unnecessary personal, confidential or sensitive information. You are responsible for obtaining any permissions required before recording or sharing information about learners, clients, employers or other individuals.

Avrio Products will take reasonable measures to protect information processed through the App. However, no online service, device or electronic storage method can be guaranteed to be completely secure.

Your use of personal information must comply with applicable South African privacy requirements, including the Protection of Personal Information Act (POPIA) where relevant.

8. Data Retention and Backups

The App is intended as a practical record-keeping tool, but it should not be treated as the only permanent copy of important professional records or evidence.

You are responsible for regularly saving, printing or exporting important reports and retaining any original evidence required for your formal portfolio, contractual obligations or professional registration.

Avrio Products is not responsible for information lost because of:

• Device loss, damage or replacement
• Cleared browser or application data
• User error or accidental deletion
• Loss of account or activation information
• Internet, browser or device failure
• Third-party service interruptions
• Circumstances reasonably beyond Avrio Products’ control

Where recovery is technically possible, Avrio Products may provide reasonable assistance but cannot guarantee that deleted or lost information can be restored.

9. Internet and Device Requirements

The App is an online web application and requires:

• A compatible internet-connected device
• A reasonably current supported web browser
• A reliable internet connection
• Permission to use relevant device and browser functions

Any internet, mobile data, device, browser or third-party service costs remain the user’s responsibility.

10. Updates and Changes

Avrio Products may update the App to:

• Improve usability or performance
• Correct faults or security concerns
• Maintain compatibility
• Add, change or discontinue features
• Meet operational or legal requirements

Reasonable changes may be made without prior notice. Where a material change significantly affects the normal use of the App, Avrio Products will take reasonable steps to communicate the change.

11. Availability and Support

Avrio Products aims to keep the App available and functioning reliably but does not guarantee uninterrupted or error-free access.

Temporary interruptions may occur because of maintenance, updates, internet failures, hosting services, security incidents or circumstances beyond reasonable control.

Reasonable product support is available for activation and normal App use. The purchase does not include unlimited technical support, customised development, device repairs, data capture services or professional ETD advice.

12. Professional and Regulatory Disclaimer

The Avrio ETD Portfolio App is a professional activity and evidence record-keeping tool.

It does not replace:

• A formally required Portfolio of Evidence
• Employer or training provider record systems
• Professional registration or renewal requirements
• Quality assurance processes
• Official learner records
• Legal, regulatory or contractual documentation
• Professional judgement or verification

Requirements may differ between employers, clients, training providers, quality assurance bodies, professional bodies and relevant authorities.

You remain responsible for confirming which records and evidence are required for your particular purpose.

13. Intellectual Property

All rights in the App, including its software, structure, branding, written content, visual design and functionality, remain the property of Avrio Products or its authorised licensors.

The name Avrio ETD Portfolio App, associated branding and App materials may not be copied or used for commercial purposes without written permission.

14. Refunds and Cancellations

Because the App is a digital product supplied with personal activation access, refund requests will be considered in accordance with applicable South African consumer law and the circumstances of the request.

A change of mind after the activation code has been supplied or used does not automatically qualify for a refund.

Nothing in these terms limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection legislation.

If the App is materially defective, contact Avrio Products promptly and provide sufficient information for the issue to be investigated.

15. Limitation of Liability

To the fullest extent permitted by law, Avrio Products will not be liable for indirect or consequential losses arising from the use of, or inability to use, the App.

This includes losses resulting from inaccurate information entered by a user, missing records, unauthorised sharing, device problems, internet interruptions or reliance on the App as the sole copy of professional evidence.

Where liability cannot lawfully be excluded, it will be limited to the extent permitted by applicable law.

16. Termination of the Licence

Avrio Products may suspend or terminate access if the licence holder:

• Shares or resells the activation code
• Allows unauthorised users to access the App
• Attempts to bypass security or activation controls
• Uses the App unlawfully
• Materially breaches these Licence Terms

Termination resulting from a material breach does not automatically entitle the licence holder to a refund.

17. Governing Law

These Licence Terms are governed by the laws of the Republic of South Africa.

Nothing in these terms removes or limits any statutory consumer or privacy rights that may apply.
